1. Introduction

The platform facilitates "one-click" restaking, portfolio monitoring, and AI-driven risk scoring. Restake.gg is a non-custodial service; it does not take possession of, nor does it have control over, user funds. All transactions are executed directly by the user through third-party wallet providers or multi-signature setups such as Safe.

These Restake.gg Interface Terms of Service (these “Terms”) govern your access to and use of the Restake.gg website available at https://restake.gg (the “Website”), the Restake.gg Application (app) accessible via the web interface, and the Restake.gg Telegram-based monitoring agent (the “Bot”, and collectively with the Website and Application, the “Platform”). The Platform is provided by [Restake.gg Entity/DAO] (“we”, “us” or “our”).

By accessing the Platform, connecting your Digital Wallet, or using the Bot, you (“User”, “you”) acknowledge that you have read and accept these Terms in full. If you do not agree to these Terms, you are not allowed to access the Platform and must immediately discontinue use.

2. Eligibility & Capacity

To be eligible to access and use the Platform, you represent and warrant that:

Age: You are at least 18 years of age or the age of majority in your jurisdiction.

Legal Capacity: You have the full right and authority to enter into this agreement.

Sanctions: You are not a "Prohibited Person" (citizen or resident of a Prohibited Jurisdiction such as the USA, Iran, North Korea, etc.) and are not subject to any international trade sanctions.

Individual vs. Entity: If you are using the Platform on behalf of a company, you represent that you have the authority to bind that entity. If you are an individual consumer, you acknowledge that you are using the Platform at your own risk.

3. Nature of the Service (Interface Only)

The Platform is a user-friendly interface designed to facilitate access to various third-party decentralized protocols (the “External Protocols”).

No Custody: Restake.gg is a non-custodial software provider. We never have access to, nor do we store, your private keys, seed phrases, or Digital Assets.

Independence: External Protocols (e.g., Avantis, Lido, Uniswap) are independent software systems. We do not operate, manage, or control them.

No Financial Advice: The Platform provides tools for monitoring and execution; it does not provide financial, investment, or tax advice to consumers or professionals.

4. AI Risk Engine & Consumer Disclaimer

The AI Risk Engine generates descriptions and safety scores based on automated analysis.

For Informational Purposes Only: Content generated by the AI is for informational purposes. It is not a recommendation to buy or sell any asset.

User Diligence: As an individual consumer, you are responsible for performing your own research. Automated scores may be inaccurate, incomplete, or delayed. We are not liable for any losses incurred based on reliance upon AI-generated data.

5. Fees and Payments

Use of the Platform may involve the following costs:

Performance Fees: A "Success Fee" taken from the net profit generated by your interaction with External Protocols.

Subscription Fees: Fixed charges for premium monitoring, automated alerting tiers and AI.

Network Fees: You are solely responsible for paying "gas fees" required by the underlying blockchain networks (e.g., Base, Ethereum) to process your transactions.

6. One-Click Restaking & Execution

The Platform offers "One-Click" features to bundle complex transactions.

Finality: Blockchain transactions are irreversible. Once you authorize a transaction via your wallet, Restake.gg cannot reverse, cancel, or recover any funds.

Slippage & Timing: Market prices change rapidly. We are not responsible for price differences (slippage) that occur between the time you click a button and the time the transaction is confirmed on the blockchain.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

Aggregate Liability: In no event shall our total liability exceed US $1,000.

Consumer Risks: You expressly acknowledge that decentralized finance is a high-risk environment. We are not liable for losses caused by smart contract exploits, protocol "rug pulls," network outages, or your own loss of wallet credentials.

No Warranty: The Platform is provided "As-Is." We make no guarantee that the service will be uninterrupted, error-free, or free from malicious third-party interference (e.g., hacking).

8. Prohibited Use

You agree not to:

Use the Platform for money laundering or any illegal activities.

Circumvent any geo-blocking or security protocols.

Use the Platform if it is illegal in your home jurisdiction to interact with DeFi protocols.

9. Intellectual Property

The names "Restake.gg," "Restake," and all associated logos and designs are our property. You are granted a limited, revocable license to use the interface for your personal or commercial digital asset management.

10. Modifications to Terms

We may update these Terms at any time. We will notify you by updating the "Last Updated" date. Your continued use of the Platform after an update constitutes acceptance of the new Terms.

11. Governing Law & Dispute Resolution

Governing Law: These Terms are governed by the laws of Ukraine.

Arbitration: Any dispute shall be resolved via binding arbitration under the International Commercial Arbitration Court (ICAC) at the Ukrainian Chamber of Commerce and Industry (UCCI) in Kyiv, Ukraine.

Individual Basis: All disputes will be resolved on an individual basis. You waive any right to participate in a class-action lawsuit or class-wide arbitration.
